Can I subdivide my property?

Clauses 4.1 and 4.2 of the Hornsby Shire Local Environmental Plan 2013 (HLEP) set out the requirements for subdivision. The HLEP includes a Lot Size Map.

What are the minimum residential allotment sizes?

You can see the minimum allotment size for each property on the Lot Size Map. As a general guide the minimum allotment sizes for R2 Low Density Residential zone range from 500 square metres to 600 square metres.

What are the minimum rural allotment sizes?

You can see the minimum allotment size for each rural property on the Lot Size Map. As a general guide the minimum for rural zoned lots are:

  • RU1 Primary Production – 10 hectares
  • RU2 Rural Landscape – 2 hectares
  • RU4 Primary Production Small lots – 2 hectares
  • RU5 Village – 500 square metres

Can the access handle be used as part of the lot size?

No. If a lot is a battle-axe or other lot with an access handle, the area of the access handle is not to be included in calculating the lot size.

What is the minimum width for an access handle?

The accessway width should be a minimum 3.5m wide for one to three lots and 4m wide for four to six lots. For larger subdivisions refer to the Hornsby Development Control Plan Subdivision chapter.

What if I have two zones on my property?

The minimum allotment size for certain split zones will be determined in accordance with Clause 4.1B of the HLEP.

Does a Section 7.11 Development Contribution levy (formerly Section 94) apply to subdivision in Hornsby Shire?

Yes, a Section 7.11 Contribution (formerly Section 94) is required for each additional lot created within a subdivision.

Payment of the contribution is required prior to the first construction certificate or the subdivision certificate, whichever comes first.

How do I apply for and get approval to subdivide in Hornsby Shire?

You need to lodge a Development Application, Construction Certificate and Subdivision Certificate with Council. The subdivision will be required to meet the requirements of the Hornsby Local Environmental Plan and the Hornsby Development Control Plan.
